Terms and Conditions for Clients / Families

Welcome to Xongjug – Home Care Services, your trusted partner for home-based caregiver support across Assam. By hiring a caregiver, nurse, or attendant through our platform, you (“Client” or “You”) agree to the following Terms and Conditions. These terms govern our relationship, protect your interests, and ensure the safety, fairness, and professionalism of our caregiving network.

1. Scope of Services

Xongjug facilitates connections between clients and pre-screened caregivers, including:

  • Elderly care attendants
  • Post-surgical support staff
  • Bedridden patient care
  • Childcare or home nursing
  • Domestic health companions

We do not employ caregivers directly; we connect clients with service providers registered with us.

2. Client Responsibilities

You agree to:

  • Provide accurate health and care requirements during registration.
  • Treat caregivers respectfully and fairly.
  • Ensure a safe, hygienic, and lawful environment for the caregiver.
  • Refrain from assigning tasks outside the agreed care plan, such as dangerous physical labor, handling hazardous substances, or unrelated jobs.

3. Booking and Payment Terms

  • Upon initial placement, clients must pay the first month’s charges to Xongjug in full.
  • Xongjug’s fee includes administrative, coordination, and service assurance charge
  • All subsequent monthly payments for ongoing services must also be made directly to Xongjug at the beginning of each month, not to the caregiver.
  • Failure to make timely payments may result in termination of services without refund.

4. Refund and Cancellation Policy

  • If a caregiver is found unsuitable, replacement may be arranged within 7 working days (based on availability).
  • If no suitable replacement is possible within 15 days, a partial refund of the remaining balance (after deducting Xongjug’s coordination charges and days served) may be considered.
  • No refund will be granted for voluntary cancellation of services or misconduct by the client.

5. Replacement and Backup Policy

  • In the event of a caregiver’s illness, family emergency, or withdrawal, Xongjug will attempt to arrange a replacement as early as possible.
  • We do not guarantee immediate replacements, especially in rural or remote areas, but will strive to support you in good faith.

6. Caregiver Conduct and Dispute Resolution

All caregivers are expected to:

  • Follow professional behavior
  • Maintain hygiene and discipline
  • Respect your privacy and household

If you face misconduct, negligence, or service dissatisfaction:

  • Report the issue immediately to Xongjug via phone or email
  • Do not engage in arguments or penal actions directly
  • Xongjug will review complaints objectively and take appropriate action, including warnings, replacement, or blacklisting

7. Confidentiality and Safety

  • Clients must respect the caregiver’s privacy and dignity.
  • Personal information about caregivers should not be shared or misused.
  • Caregivers should not be subjected to surveillance, coercion, or harassment of any kind.
  • Any medical records or sensitive data shared with Xongjug will be kept strictly confidential.

8. Non-Solicitation and Bypassing Policy

  • Clients shall not hire or engage a caregiver privately (outside of Xongjug) during or up to 6 months after the termination of the engagement.
  • Any bypass or direct dealing will be treated as a breach of contract, and legal action or penalty may be pursued.
  • This clause helps ensure fair opportunity and safety for both clients and caregivers through a regulated system.

9. Legal Disclaimer and Limitation of Liability

  • While we verify credentials and conduct basic checks, Xongjug is not legally responsible for any criminal, medical, or personal misconduct by caregivers beyond our knowledge.
  • Xongjug shall not be held liable for:
    • Injury, theft, property damage, or death
    • Any direct or indirect losses or misuse of services
    • Medical complications arising during caregiving

We recommend securing valuables and supervising care in sensitive cases.

10. Service Termination

We reserve the right to:

  • Terminate services in case of abuse, non-payment, or misconduct by the client
  • Refuse future services if previous interactions violated terms or placed caregivers at risk

You may also choose to terminate services with at least 7 days’ prior notice in writing.

11. Amendments and Updates

These Terms may be updated periodically. Continued use of our services after updates constitutes acceptance of the revised Terms. Clients are advised to review the Terms occasionally for any changes.

12. Governing Law

These Terms shall be governed by the laws of India, with jurisdiction in the appropriate Assam-based legal courts for any disputes.
