By accessing or using our platform, including our website, mobile apps, or any services offered (collectively referred to as the “Services”), you agree to comply with and be bound by these Terms of Use. If you do not agree to these terms, please do not use the Services.

1. Acceptance of Terms

By accessing or using the Xongjug platform, you agree to be bound by these Terms of Use. If you are using the platform on behalf of an organization or entity, you represent that you have the authority to bind that organization or entity to these Terms.

Xongjug reserves the right to modify or update these Terms at any time, and you agree to be bound by such changes upon posting on this page. It is your responsibility to review these Terms periodically.

2. Services Provided

Xongjug provides a platform to connect clients/families with caregivers for home care services. These services may include, but are not limited to:

  • Elderly care
  • Childcare
  • Nursing assistance
  • Post-surgical care
  • Specialized health support (e.g., bedridden patients)

We act as an intermediary, providing access to caregivers but do not employ or directly supervise the caregivers. Our role is to connect clients with caregivers who meet the necessary qualifications and expertise.

3. Eligibility

To use the Services, you must:

  • Be at least 18 years old
  • Have the legal capacity to enter into binding contracts
  • Agree to comply with all applicable laws and regulations while using the platform

By using the Services, you represent and warrant that you meet these eligibility requirements.

4. Account Registration and Security

To access certain features of the Services, you may be required to create an account. When registering, you agree to:

  • Provide accurate, complete, and up-to-date information
  • Maintain the confidentiality of your account credentials
  • Immediately notify Xongjug if you suspect unauthorized use of your account

You are responsible for all activities that occur under your account, and Xongjug is not liable for any unauthorized access resulting from your failure to maintain account security.

5. User Responsibilities

As a user of the Xongjug platform, you agree to:

  • Provide accurate and truthful information during registration and throughout the use of the platform
  • Respect caregivers’ rights, including their privacy and dignity
  • Use the platform for lawful purposes only and in accordance with all applicable laws and regulations
  • Follow all instructions provided by Xongjug related to the use of the Services

You agree not to:

  • Engage in any discriminatory, harassing, or unlawful conduct while interacting with caregivers or other users
  • Solicit, employ, or hire caregivers outside of the platform for services not related to the platform
  • Engage in fraudulent activities, including falsifying personal information or misrepresenting service requirements

6. Payment Terms

  • Clients must pay Xongjug’s service fees upfront for the first month of services.
  • Subsequent payments for services should be made directly to the caregiver as per the agreement between the client and caregiver.
  • Refunds will be processed according to the Refund and Cancellation Policy.

For any payment-related inquiries or issues, clients and caregivers must reach out to the Xongjug support team at the contact details provided on the website.

7. Dispute Resolution

In the event of a dispute between clients and caregivers, both parties are encouraged to resolve the issue directly. However, Xongjug is available to mediate disputes related to:

  • Service quality
  • Payment issues
  • Caregiver misconduct

For unresolved disputes, Xongjug reserves the right to terminate or suspend services for the offending party, in accordance with our Termination Policy.

8. Caregiver and Client Conduct

Clients agree to treat caregivers respectfully and professionally, providing a safe working environment for them. Caregivers, in turn, must adhere to the following guidelines:

  • Maintain professional conduct and respect client privacy
  • Provide services as outlined and agreed upon
  • Adhere to hygiene and safety protocols

Both parties must communicate any service concerns, changes, or requests directly through the Xongjug platform to ensure mutual understanding and agreement.

9. Confidentiality

Xongjug respects the privacy and confidentiality of both clients and caregivers. We take reasonable measures to protect your personal information from unauthorized access, use, or disclosure. By using our platform, you agree to the collection and use of your data as described in our Privacy Policy.

10. Platform Availability and Limitation of Liability

  • Xongjug aims to keep the platform operational at all times, but does not guarantee uninterrupted service.
  • We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, without prior notice.
  • Xongjug is not liable for any direct, indirect, incidental, or consequential damages arising from the use of the platform or services, including but not limited to lost data, lost opportunities, or interruptions to service.

11. Termination of Use

Xongjug reserves the right to suspend or terminate your access to the platform at our sole discretion, without prior notice, if we believe that you have violated these Terms of Use, engaged in fraudulent activities, or otherwise acted inappropriately.

As a user, you may terminate your use of the Services at any time by discontinuing access to the platform. Termination of your account will not affect any obligations owed to Xongjug or caregivers that arose prior to the termination.

12. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts Nagaon in Assam, India.

13. Changes to These Terms

Xongjug reserves the right to update, modify, or revise these Terms of Use at any time. Any such changes will be posted on this page with an updated effective date. By continuing to use the platform after the changes, you accept and agree to the updated Terms.
